GENERAL POLICES

  1. All cars sold with a drive must be finalized within one hour (60 min.).
  2. All titles submitted by seller must be in seller’s name.
  3. All information on titles and reassignments must be completed by selling dealer, INCLUDING BLANKS FOR ODOMETER READINGS.
  4. All titles and ownership papers on sold cars must be processed through the office.
  5. When “title attached” is not announced on the block, the buyer has the right to reject the car.
  6. If there is a title clerical error or incomplete documentation, the Auction shall be given reasonable time after receiving notice to have error corrected.
  7. The auction is not responsible for mailed titles that are not received.
  8. No vehicle will be offered for sale without a VIN plate. The auction reserves the right to refuse the sale of any vehicle on which the vehicle identification plate appears marred or in any way altered.
  9. All cars purchased and/or sold on the premises must be paid for through the office.
  10. All salvage, flood, and gray market vehicles must be sold under the yellow light and such conditions must be announced.
  11. All units sold under the red light or announced “AS-IS” must be paid for immediately. No driving privileges.
  12. Outside or off block sales must be consummated through the auction and all sales will be “AS-IS”.
  13. The AUCTION does not guarantee the year of any house trailer, motor home, boat, boat motor, antique, dune buggy, motorcycle, or reconstructed vehicle.
  14. All complaints must be submitted to arbitration within one (1) hour of purchase.
  15. Speed limit is 15 mph on customer and sale lot. This rule will be strictly enforced.
  16. All vehicles left on auction grounds are at owner’s risk. The auction is not liable for damage or theft.
  17. Any vehicle left on the premises over 30 days is subjected to be towed at owner’s expense.
  18. No vehicle will be sold without a title.
  19. All vehicles sold as an if bid:
    Seller has one hour to accept or counter offer to buyer.
    Buyer has the right to decline purchase of vehicle after one hour if seller has not approved.

AUCTION MANAGEMENT RESERVES THE RIGHT TO SUSPEND OR REVOKE DEALER PRIVILEGES AT ANY TIME. THE DECISION OF THE AUCTION MANAGEMENT SHALL BE FINAL IN ALL DISPUTES.

ARBITRATION POLICIES

SUBJECT TO ARBITRATION (Unless announced)

  1. Motor defects or excessive noise.
  2. Transmission-Clutch-Rear end.
  3. Frame damage and excessive frame or floor rust, repaired or not, must be announced.
  4. Brakes-when vehicle is considered by arbitration to be unsafe to drive.
  5. Front end problems when considered by arbitration to be unsafe to drive.

NOT SUBJECT TO ARBITRATION

  1. Leaking or wet transmissions.
  2. Frame damage from normal use (scratches, scrapes, minor indentations, not resulting from accidents).
  3. Any repair not explained but costing less than $1,000.00.
  4. Visible items such as bodywork, paint work, tires, upholstery, glass, etc.

DEALERS ONLY SALE

No retail customers allowed. This sale is for licensed and registered dealers only. You MUST be registered to buy or sell. Unauthorized persons are not allowed on auction premises. All cars registered here are subject to inspection by the State Police, the Federal Bureau of Investigation and National Auto and Theft Bureau.

AS – IS

  1. Flood, livery use vehicles and police cars must be announced.
  2. Frame damage or excessive frame or floor rust, repaired or not, must be announced.
  3. The buyer assumes total responsibility for mechanical defects.

LIGHT SYSTEM

GREEN LIGHT – WITH DRIVE

Dealer is selling a mechanically sound vehicle with a drive. Vehicle mechanically sound up to $1000.00.

YELLOW LIGHT – DEFECT

Selling dealer must announce any item subject to arbitration.

BLUE LIGHT – TITLE ATTACHED

Assignable title does not accompany vehicle. The auction must receive title within 21 consecutive days from day of sale.

BUYER IS CAUTIONED NOT TO SPEND ANY MONEY ON UNIT AND NOT TO SELL UNIT UNTIL TITLE IS RECEIVED. THE AUCTION MUST BE NOTIFIED TWENTYFOUR (24) HOURS PRIOR TO THE RETURN OF THE UNIT FOR FAILURE TO RECEIVE TITLE.

RED LIGHT – AS-IS

These units cannot be rejected (subject to proper announcement).

WHITE LIGHT

Seller must announce: (1) Mileage stated is in excess of its mechanical limits. (2) Odometer reading is not the actual mileage.

ANY IRREGULARITY IN ODOMETER READINGS MUST BE BROUGHT TO THE ATTENTION OF AUCTION MANAGEMENT ON THE DAY OF SALE. CAPITAL AUTO AUCTION ASSUMES NO RESPONSIBILITY NOR GUARANTEES ACCURACY OF ODOMETER READING. BUYERS WATCH LIGHTS AND LISTEN TO ANNOUNCED CONDITIONS.

Please examine cars before bidding and be familiar with all announced conditions of unit.

All vehicles must be paid for within ninety (90) minutes of purchase. Any vehicle not paid for the day of the sale is subject to a late fee.

SELLERS

Seller is responsible to ensure the year, model, bid price, announcements and odometer information is correctly noted on vehicle and block sheet. Vehicles which are unsafe to operate will not run through the auction lanes. Seller or seller’s agent must be present to represent your cars accurately and fairly and make sure proper light(s) are on.

POST SALE

Any Vehicle left on the lot over 30 days is subjected to be towed at owner's expense.

ID CARDS

Buyers and sellers should always use their I.D. Card to enter their cars for sale and sign for purchases. If you have lost your I.D. Card or it is badly worn, a new one will be made for you at the main office upon request. Please help us to serve you better by always using your I.D. Card.

BE PREPARED TO SHOW YOUR I.D. CARD TO OUR SECURITY PERSONNEL AT ALL TIME.

AS-IS EVEN IF SOLD WITH DRIVE

  • ANY VEHICLE WITH 100,000 MILES OR MORE.
  • ANY VEHICLE 10 YEARS OLD OR OLDER.
  • ANY VEHICLE SELLING FOR LESS THAN $1000.00.
  • ANY VEHICLE NOT SOLD ON THE BLOCK.
  • ANY VEHICLE SOLD FOR $1000.00 OR LESS CANNOT BE TURNED DOWN OR RETURNED FOR ANY REASON INCLUDING FRAME DAMAGE.

These sales are absolute. Any adjusted price automatically makes the sale AS-IS. Decisions of the Arbitration Manager are final and not subject to change by any other auction personnel. Any dealer found abusing their arbitration privileges will have them suspended.

RETURNED VEHICLES

The buyer has the right to return a vehicle for auction inspection if the vehicle is found to have any of the following defects that were not announced:

  1. Salvage
  2. Reconstruction
  3. Unibody Damage
  4. Frame Damage
  5. Flood Damage
  6. Fire Damage

The auction must be notified within seven (7) days of such problems. NO CARS WILL BE ACCEPTED AFTER THE SEVEN (7) DAY PERIOD. CARS MUST BE RETURNED IN THE SAME CONDITION AS PURCHASED. If the complaint is found to be legitimate, the selling dealer must buy the vehicle back. THE AUCTION WILL NOT GO BACK TO ANY PREVIOUS SELLER. AND WILL NOT BE RESPONSIBLE FOR FREIGHT, TOWING, OR REPAIRS ON ANY RETURNED VEHICLES.
